CONTRACTOR COMPLIANCE: A Practical Guide to Onboarding, Managing and Terminating TAWs and Limited Company Contractors.

Session Overview

This practical, two-hour masterclass will be hosted by Mary Seery Kearney BL, Barrister-at-Law and Director of The HR Brief Ltd. The session is designed specifically for recruitment and staffing professionals who place contractors, whether through temporary agency work arrangements or as limited company or umbrella company contractors.

Drawing on direct experience advising the recruitment sector, this session goes beyond theory to give participants a complete, working understanding of their obligations and the practical steps needed to meet them, from first contact to final termination.

1. Onboarding a Contractor: Getting It Right from Day One

Understanding the key distinctions between TAW and limited company / umbrella company contractors; the criteria that determine classification; the documentation and due diligence required at onboarding; and the common errors that create legal exposure later.

 

2. Employment Legislation for TAWs: What Every Agency Must Know

A practical walkthrough of the legislative framework governing temporary agency workers in Ireland, including the Protection of Employees (Temporary Agency Work) Act 2012, equal treatment obligations, hirer responsibilities, and where agency liability arises. Particular focus on the provisions that most frequently give rise to WRC complaints.

 

3. Commercial Legislation for Umbrella and Limited Company Contractors

The commercial and contractual framework that governs limited company and umbrella company arrangements, including contractual chain liability, the implications of IR35-equivalent considerations, and what to look for when the commercial structure does not reflect the operational reality on the ground.

 

4. Termination: TAWs and Limited Company Contractors

A step-by-step guide to ending both types of engagement correctly, including the procedural requirements, notice obligations, the role of the hirer, and how to manage client-driven terminations in a way that minimises legal risk to the agency.
